Terms of Service
Sparkplate
Effective date: November 2, 2026
1. The agreement and what Sparkplate is
These Terms of Service ("Terms") are an agreement between you and Sparkplate, operated by Derrick Lyons, based in Sacramento, California ("Sparkplate," "we," "us"). By creating an account or using the Sparkplate app or sparkplateapp.com, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use Sparkplate.
Sparkplate is a community platform that connects people. Cooks showcase their food, and customers discover them, message them, and arrange meals directly.
Sparkplate is not a party to any deal. We do not:
- prepare, inspect, store, or deliver food
- set prices or process payments
- employ cooks, who are independent and not our agents or employees
- guarantee the quality, safety, legality, or availability of any food, or that any user will follow through on a deal
Cooks and customers agree on the dish, price, payment method, and pickup or delivery between themselves, and each is responsible for their own part of that arrangement.
2. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use Sparkplate.
- Accurate information: provide true, current information and keep it updated. One person, one account.
- Account security: you are responsible for activity on your account. Keep your sign-in details private and tell us right away if you suspect unauthorized use.
- Cook types: cooks must choose the label that honestly describes them: Home Cook, Home Baker, or Professional Chef.
- Professional Chef verification: the Professional Chef label requires submitting credentials, such as a culinary certificate, food handler card, or proof of professional experience. Until we approve it, the profile shows as Pending or as Home Cook. Verification only means we reviewed the documents submitted; it is not an endorsement or guarantee of a cook's skill, food safety, or legal compliance.
- Misrepresentation: we may remove a label or suspend an account that misrepresents its cook type, credentials, or identity.
3. Cook responsibilities
Cooks are solely responsible for the food they offer and for following the law where they cook and sell.
If you offer food on Sparkplate, you agree to:
- Follow food laws. Comply with all laws that apply to you, including cottage food laws, permits, licenses, inspections, labeling, sales limits, and tax obligations. Rules differ by state, county, and city, and some foods may not be legal for you to sell from home.
- List accurately. Describe each dish honestly, including ingredients, serving size, and price.
- Use real photos. Post only photos of food you actually made, taken by you or with permission. No AI-generated, stock, or borrowed images of food.
- Disclose allergens. Provide accurate allergen information on your profile and answer customers' allergy questions truthfully. If you can't confirm a dish is free of an allergen, say so.
- Handle food safely. Prepare, store, package, and transport food safely and hygienically.
- Honor your deals. Provide what you agreed to, on the agreed date, or tell the customer promptly if something changes.
4. Customer responsibilities and messaging rules
Customers start conversations, and everyone keeps them honest, respectful, and fair.
Customers agree to:
- Tell cooks about any allergies or dietary needs before agreeing to a deal, and decide for yourself whether a dish is safe for you.
- Communicate honestly and follow through on deals you confirm, including showing up and paying as agreed.
Messaging rules for everyone:
- Customers message first. Only customers can start a conversation. Cooks may reply once a customer reaches out.
- No poaching or undercutting. Cooks may not contact customers who are talking with another cook, or use Sparkplate to undercut other cooks' prices.
- No spam or harassment. Don't send unwanted promotions, repeated messages after someone stops responding, or abusive content.
- Off-app contact is at your own risk. If you move a conversation to phone, text, or another app, Sparkplate can't help with problems that happen there.
5. Deals and reviews
When both people confirm a deal, both must review each other afterward, honestly and on time.
- Deal Made: a deal is recorded when both the cook and customer confirm it in the app and set a pickup or delivery date. Changes to a deal take effect only when both people confirm them.
- Happened or Didn't happen: after the agreed date, one person marks whether the deal happened and the other is asked to confirm. If you disagree, we may review the deal and related messages to decide how it's recorded.
- Mandatory reviews: after a deal, both people must leave a review within the review period shown in the app (currently 2 days after the agreed date). Users with an overdue review cannot start new deals until it's completed.
- Honest reviews: reviews must reflect your real experience. Customer reviews include real photos of the food received.
- Not allowed: fake reviews, reviewing your own account, trading or paying for reviews, pressuring someone to change a review, or posting reviews to harass someone.
- Removal: we may remove reviews that break these Terms. We don't remove reviews just because they are negative.
6. Your content and prohibited conduct
You own what you post, you give us permission to display it, and some content and conduct are not allowed.
Your content: you keep ownership of the photos, descriptions, messages, and reviews you post. You give Sparkplate a non-exclusive, worldwide, royalty-free license to host, display, and share that content to operate and promote Sparkplate, for example showing a dish photo on your profile or in app store screenshots. The license ends when you delete the content or your account, except for reviews kept in anonymous form and content others have already shared. You confirm you have the rights to everything you post.
You may not:
- Offer alcohol, cannabis or any food containing it, controlled substances, or any food that is illegal to sell where you are.
- Post false, misleading, hateful, sexual, violent, or discriminatory content.
- Harass, threaten, stalk, or discriminate against anyone, including based on race, religion, gender, sexual orientation, disability, or national origin.
- Impersonate anyone or misrepresent your identity, credentials, or food.
- Commit fraud or scams, or knowingly refuse to pay or deliver as agreed.
- Scrape data, create fake accounts, or interfere with how the app works.
- Use Sparkplate for anything illegal.
7. Safety, moderation, and suspension
Please take sensible precautions when meeting people, and know that we may remove content or accounts that break these Terms.
Safety: Sparkplate does not run background checks, inspect kitchens, or verify identities, except for reviewing credential documents for the Professional Chef label. When arranging a pickup or delivery:
- Meet in a public place when possible, or tell someone where you're going.
- Trust your instincts and cancel if something feels wrong.
- Report unsafe behavior in the app. In an emergency, contact local authorities first.
Moderation: we may review reported content and accounts, and we may remove content, remove a cook label, limit features, or suspend or permanently close an account that breaks these Terms or puts others at risk. We usually give a warning first, but may act immediately in serious cases. If you believe we made a mistake, email support@sparkplateapp.com.
8. Fees and future upgrades
Sparkplate is currently free to use, and we may offer optional paid upgrades later.
We don't charge cooks or customers for using Sparkplate today, and we don't take a cut of any deal. In the future we may offer optional paid features, such as profile upgrades or featured placement. Paid features will be clearly labeled with their price before you buy, and purchases made in the app are handled by Apple or Google under their terms. We'll give notice before any change that would start charging for features that are currently free.
9. Disclaimers, liability, and indemnification
Sparkplate is provided as is, our liability is limited, and you are responsible for claims arising from your own conduct.
Disclaimers: Sparkplate is provided "as is" and "as available." To the fullest extent allowed by law, we make no warranties, express or implied, including about the food offered, the users you meet, or the app being uninterrupted or error-free. You use Sparkplate, eat food arranged through it, and meet other users at your own risk.
Limitation of liability: to the fullest extent allowed by law, Sparkplate will not be liable for indirect, incidental, special, or consequential damages, or for any illness, injury, loss, or damage resulting from food, deals, meetups, or other users' conduct. Our total liability for any claim related to Sparkplate is limited to the greater of the amount you paid us in the 12 months before the claim, or $100.
Indemnification: you agree to defend and hold Sparkplate harmless from claims, losses, and expenses, including reasonable legal fees, arising from your food, your deals, your content, your violation of these Terms or the law, or your interactions with other users.
Some places don't allow certain limits on liability, so some of these limits may not apply to you.
10. Disputes, changes, and contact
Users settle deal disputes with each other, disputes with us start with an email, and we'll tell you about important changes.
- Disputes between users: cooks and customers are responsible for resolving problems with their deals. We may help by reviewing reports, but we aren't required to, and we don't issue refunds for deals because we don't handle payments.
- Disputes with Sparkplate: please email support@sparkplateapp.com first so we can try to resolve it informally. These Terms are governed by the laws of the State of California, and any legal action will be brought in the courts located in Sacramento County, California, unless the law requires otherwise.
- Changes to these Terms: we may update these Terms as Sparkplate grows. We'll update the effective date and notify you of significant changes in the app or by email. Continuing to use Sparkplate after changes take effect means you accept them.
- Ending your account: you can delete your account at any time in Settings, or as described on our account deletion page. Sections that by their nature should continue, such as content licenses for reviews, disclaimers, liability limits, and indemnification, survive after your account ends.
